Seller’s identity
These general terms and conditions of sale govern sales concluded on the muzard-sarl.com website between Muzard SARL, société à responsabilité limitée (SARL) au capital de 19200 €, RCS Clermont-Ferrand 789 100 203, TVA FR04789100203, dont le siège est situé 19 Route de Sainte-Marguerite, 63300 Thiers, France (téléphone +33 (0)4 73 51 39 80, e-mail ), hereinafter “the Seller”, and any person who places an order, hereinafter “the Customer”. The legal notice of the site can be viewed on the page Legal notice.
Purpose and acceptance
These terms define the rights and obligations of the parties in connection with the distance sale of materials and objects for knifemaking (scales, blanks, handles, horns, bone, mammoth ivory, accessories…) offered on the site. Any order implies prior review and acceptance of these terms, which the Customer confirms by ticking the box provided before validating the order. The terms that apply are those in force on the day of the order. The contract is concluded in French.
Certain provisions (right of withdrawal, legal guarantees, consumer mediation) are reserved for consumers, i.e. natural persons acting for purposes that fall outside their professional activity.
Products
The essential characteristics of the products (nature, dimensions, species, condition) are presented on each product page. The materials are natural: grain, colours, patterns and dimensions vary from one piece to another, and photographs are not contractually binding as to the exact appearance of the piece delivered, except for products sold individually where the photograph shows the piece itself. Offers are valid while stocks last.
Prices
Prices are shown in euros, all taxes included (French VAT included), excluding delivery costs. Delivery costs, which depend on the delivery method chosen, the destination and the order amount, are shown before the order is validated. The price that applies is the one displayed at the time of the order; the Seller may change its prices at any time, without effect on orders already validated. Customers not subject to French VAT (outside the European Union, for example) are invited to contact the Seller before ordering.
Order, payment and confirmation
The order is concluded when the Customer has validated their basket, entered their details, accepted these terms and clicked the “Order with obligation to pay” button. Payment is made by bank card on the secure page of our payment provider (3-D Secure authentication); the Seller neither receives nor stores card numbers. The Seller confirms the order by e-mail to the address given by the Customer; this e-mail summarises the order, the price, the delivery costs and the information relating to the right of withdrawal.
The Seller reserves the right to refuse or cancel an order in the event of a dispute with the Customer, of a payment that is impossible or refused, or of a product that has become unavailable (the Customer is then notified and refunded without delay).
Delivery
Products are normally dispatched within 2 working days of receipt of payment, and delivered no later than 30 days after the conclusion of the contract (Article L. 216-1 of the French Consumer Code), except in the event of unavailability or an event beyond the Seller’s control, of which the Customer is informed. Transit times depend on the service chosen (Colissimo home delivery with or without signature, pick-up point) and are shown at the time of the order; in-store collection in Thiers is also offered. Products are delivered to the address given by the Customer, within the areas served; parcel tracking is sent by e-mail.
The risk of loss or damage to the products passes to the Customer when they, or a third party designated by them, take physical possession of the products. On receipt, the Customer checks the condition of the parcel. In the event of a damaged parcel or a missing product, we invite them to state specific reservations to the carrier or pick-up point and to notify us as soon as possible, preferably within 2 working days, with photographs: these formalities make it easier to handle the claim with the carrier but do not deprive the Customer of their legal rights. In the event of delay or loss, the Seller opens an investigation with the carrier and, if the parcel is lost, sends a new identical parcel or refunds the Customer.
Delivery error and non-conforming product
In the event of a delivery error or a product that does not match the order, the Customer contacts the Seller as soon as possible. The product is taken back in its original packaging and returned to the correct address or refunded; return costs are borne by the Seller when the error is attributable to them. This procedure does not deprive the Customer of the legal guarantees below.
Right of withdrawal
The consumer has a period of 14 days from receipt of their order to withdraw, without having to give a reason (Articles L. 221-18 et seq. of the French Consumer Code). They can do so online using the “Withdraw from the contract here” function (link in the footer), or by e-mail or post using the model form available on the Right of withdrawal and returns page.
Return costs are borne by the consumer. The Seller refunds all sums paid, including standard delivery costs, no later than 14 days after being informed of the decision to withdraw, using the same payment method as that used for the order, unless the consumer expressly agrees otherwise; it may defer the refund until the products are received or proof of their dispatch is provided. The consumer is only liable for any loss in value resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the products.
In accordance with Article L. 221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for goods made to the consumer’s specifications or clearly personalised.
Legal guarantees
The Seller is bound by the legal guarantee of conformity (Articles L. 217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code), independently of any commercial guarantee.
- The consumer has a period of 2 years from delivery of the goods to act under the legal guarantee of conformity; they do not have to prove that the defect existed at the time of delivery during the 24 months following it (12 months for second-hand goods).
- In the event of a lack of conformity, the consumer chooses between repair and replacement of the goods (unless the cost is manifestly disproportionate); failing that, they may obtain a price reduction or termination of the contract. They do not have to bear the costs of bringing the goods into conformity.
- The consumer may also act under the guarantee against hidden defects, within 2 years of discovering the defect, choosing between cancellation of the sale and a price reduction.
- Natural variations in appearance specific to natural materials (grain, colour, small original cracks, knots…) do not constitute a lack of conformity when they are inherent to the material.
Proof and archiving
The Seller’s computerised records, kept under reasonable security conditions, are evidence of the communications, orders and payments between the parties. For any order above €120, the Seller keeps the contract for 10 years and guarantees the Customer access to it on simple request (Article L. 213-1 of the French Consumer Code).
Personal data
The data collected during the order is necessary for processing it, for delivery and for accounting obligations. Information on how it is processed and kept, and on exercising the rights of access, rectification, erasure, objection, restriction and portability, is set out in the privacy policy.
Force majeure
Neither party shall be held liable for failing to perform its obligations where this results from a case of force majeure within the meaning of Article 1218 of the French Civil Code (an event beyond the debtor’s control that could not reasonably have been foreseen when the contract was concluded and whose effects cannot be avoided by appropriate measures), including blockage of transport or communication means, natural disaster, fire, strike or epidemic. The affected party notifies the other within ten working days; if the impediment lasts more than one month, the contract may be terminated by the injured party.
Intellectual property
The use of the trademarks, logos, photographs and texts on the site is prohibited without the Seller’s written authorisation.
General provisions
If any provision of these terms were declared null or unenforceable, the other provisions would remain in force. A party’s failure to rely on a breach by the other does not constitute a waiver of the right to rely on it later.
Complaints, mediation and governing law
For any complaint, the Customer should first contact the Seller ( or by post at the address above), who will endeavour to find an amicable solution.
If the dispute persists, the consumer may use, free of charge, the consumer mediator to whom the Seller is attached: A compléter, A compléter, https://a-completer.fr (Articles L. 611-1 et seq. of the French Consumer Code).
These terms are governed by French law. Failing an amicable resolution, and subject to mandatory jurisdiction rules applicable to consumers, the French courts have jurisdiction; in the case of a sale to a professional, any dispute relating to the sale falls within the jurisdiction of the Clermont-Ferrand commercial court.
